This Privacy Policy is formulated to publicize to the users our policies and procedures regarding the collection, use and disclosure of Personal Information collected in connection with the InstaVoice and Channels Services being provided by us.

InstaVoice is an instant voice messaging application which enables users to send and receive short voice messages to and from other InstaVoice users. With built-in celebrity and infotainment channels, it also allows users to post their voice on Facebook and Twitter.

Channels is a service which allows you to record any voice snippet and upload and share it through online social networking platforms or websites that focus on building and reflecting of social networks or social relations among people.

The Privacy guidelines described below are relevant to both the InstaVoice and Channels services collectively, hereinafter referred to as the "Services", since InstaVoice App also utilizes the Channels interface. The Services are currently being provided by Kirusa Inc. having its offices at 139 South Street, Suite 205, New Providence, NJ 07974, USA ("Kirusa"). The use of the term "You" shall mean any natural or legal persons who has agreed to become a user of the Services.

By using the Services, You consent to the collection and use of your Personal Information by us consistent with applicable data protection law and this Privacy Policy which is expressly incorporated into any applicable website or Terms of Use. You also represent to us that You have any and all authorizations necessary to use these Services including using them to process Personal Information. We collect and use the information You provide to us, including information obtained from Your use of the Services. Also, we may use the information that we collect for our internal purposes to develop, tune, enhance, and improve our Services, and for advertising and marketing consistent with this Privacy Policy. By using the Services, You acknowledge, consent and agree that we may collect, process, and use the information that You provide to us and that such information shall only be used by us or third parties acting under our direction, pursuant to confidentiality agreements, to develop, tune, enhance, and improve the Services.

Information Collection And Use

Data We Collect

Data You Provide To Us


When You create a Channels/InstaVoice account, You provide certain personal information, including Your name, phone number/email address and password ("Personal Information"). For the Channels service, You also provide Your gender and date of birth. Some of this information, for example, Your name is listed publicly on our Services, including on Your profile page and in search results. However, all of these Services, such as search and viewing of public user profiles require registration.


You have choices about the information on your profile such as Your address, a short description (in case of Channels service), a picture of Yourself or even a link to Your personal website/blog. When You create a Channels Account, some Personal Information about Your Account and Your account activity will be provided to other users of the Service only if you opt to make your profile 'public'. In doing so, You make Your profile visible to others. This may include Your education and organization, Your state and country of residence, the number of users following You and vice versa.


As an InstaVoice Application user, we import Your address book, and in that process we receive names and phone numbers of your contacts (including contact information your service provider(s) or app automatically added to your address book when you communicated with addresses or numbers not already in your list).

If you sync your contacts with our Services, we will collect your address book to keep growing your network by suggesting connections for you and others.

Data From Others

Channels (Voice Blog Posts), Following, Groups and other Public Information

Our Services are primarily designed to help You share information with the world or at least to users from Your country/territory. Most of the messages that You blog for communicating with Your friends, family and close groups, are intended to be held private. By this, only those users who will follow You, will be able to view the messages You posted. However, users who do not follow You, will not be able to view any of Your messages.

For campaign related Channels, that You post to participate in a brand contest, or vote for a screen star/celebrity, the intention is to make the information public by posting it to Your linked social media accounts (for e.g., Facebook and Twitter). Only the third-party accounts that You Yourself have linked from Your account in the website will be considered for such posting.

We encourage You to make the information You provide to reach out to as many users as possible and hence make it public, but we also want You to be careful while sharing information publicly as part of your blog posts or links to photos and videos via our Services. We provide You with settings by which You can manage privacy of Your data. If You keep Your profile as 'Private', other Channels users will not be able to see Your Sent Channels, Followers and Following Channels. Only some basic Personal Information will be available for public viewing. If Your profile is public, anybody would be able to follow You. In case it is private, You will receive a special notification (email/SMS) to approve the follow request. You can make Your profile Private from the Account Settings tab. By default, it is public.

If You want to prevent a specific follower to view Your posts (even after retaining Your profile as type public), You can 'block' that person and remove him from Your connection list. You also have the capability to 'unblock' him as and when desired.

Contacts, Location and Registered Services

We receive personal data (including contact information) about you when others import or sync their contacts with our Services, associate their contacts with Member profiles, or send messages using our Services.

Any Personal Information or audio/text/video content that You voluntarily disclose on our site could become publicly available depending on your account preferences (in case you have a 'Public' profile) and could be collected and used by others. So You should be careful while sharing such information. Please note that in the website (, if Your account is public, then your posts are visible to everyone irrespective of whether You are followed or not. If Your account is private, your posts are visible to only those who Follow You. In the Kirusa Channels App, latest posts will not be visible if You are not followed (irrespective of whether Your profile is 'private' or not).

You may choose to publish Your location in Your voice and text messages or blog posts.

You may choose to update Your settings (via or the InstaVoice Visual Voicemail App) with Your address. If Your profile is public, this might be visible to others. You can enable location sharing from the InstaVoice Voicemail App.

In either of the above ways, You can disable location info or update Your settings to remove Your address at any point of time.

Cookies, Web Beacons and Other Similar Technologies

We use cookies, web beacons log file information and other similar technologies to recognize you and/or your device(s) on, off and across different Services and devices.

A cookie is a small data file that is transferred to Your computer's hard disk. Most Internet browsers automatically accept cookies. You can instruct Your browser, by changing its settings, to stop accepting cookies or to prompt You before accepting a cookie from the websites you visit. However, some Services may not function properly if You disable cookies.

How We Use Your Data

How we use your personal data will depend on which Services you use, how you use those Services and the choices you make in your settings.

We use the data that we have about you to provide and personalize our Services so that they can be more relevant and useful to you and others.

Call Completion Services

Our Services will collectively enable you to manage calls, voicemail and missed call alerts, even when your phone is switched off.

We will have access to your Voicemail data to offer voicemail transcription service, wherein your voicemail is converted to text using a third-party speech-to-text service.

We will have access to your phone and carrier data to show missed call alerts when your phone was unreachable by your carrier.

Service Usage Improvement and To Stay Connected with Preferred Contacts

We may record information about Your usage, such as when You use the Service, the contacts You communicate with, the Channels Services You create or listen to, and the frequency and size of data transfers, as well as information You display or access using the Service. If You are logged in, we may associate that information with Your account.

We may use Your Personal Information to send You information about our Services (for e.g., notifying You of major Channels/InstaVoice Service changes or for customer service purposes) or to market to You. You could decide to use Your account settings to unsubscribe from notifications from Channels.

As part of your InstaVoice App settings, You provide us to enable/disable Your voicemail and missed call email notifications.

We may use Your contact information to help others find your Channels/InstaVoice account As an InstaVoice Application user, You may choose to upload Your address book so that we can help You find InstaVoice users You know. We may later make suggestions to You and other users on Channels/InstaVoice based on imported address book contacts. If You email or message us, we may keep certain Personal Information such as Your message, email address and contact information to respond to Your request.

Location Information

You may choose to publish Your location in Your voice/text/video messages or blog posts and update your address in Your InstaVoice/Channels profile. We may also use other data from Your device to determine location; for example, information about wireless networks or cell towers near Your mobile device, or Your IP address. We may use and store information about Your location to provide features of our Services, such as sending voice messages with Your location, and to improve and customize the Services.

Offers and Promotions

Subject to applicable laws, we may use your Personal Information for the purpose of sending You messages (whether by email, SMS or other means) in order to promote or advertise our goods and services and the goods and services of our affiliates and partners, including social media, entertainment, on-line advertising services(including in-app advertisements or display advertisements on the internet), e-commerce, information and communications software and services; and any other goods and services that we think may be relevant to You. We use cookies, web beacons log file information and other similar technologies to: (a) collect additional website usage date and to improve our Services; (a) store information so that You will not have to re-enter it during your visit or the next time You access Your Account; (b) provide custom, personalized content and information; (c) monitor the effectiveness of our marketing campaigns; (d) monitor aggregate metrics such as total number of visitors and pages viewed; and (e) track Your entries, submissions, and status in promotions, sweepstakes, and contests.

Speech Data Processing

Some of our Services require You to enter Speech Data in order to use and derive the benefits of these Services. The Services collect and process the Speech Data You input into our products. We or third parties acting under our direction, pursuant to confidentiality agreements, may use the Speech Data to develop, tune, enhance, and improve our services. We will not use the contents of any Speech Data provided to us through your use of Services for any purpose except as set forth above. "Speech Data" means the audio files, associated text and transcriptions and log files provided by You hereunder or generated in connection with our products. Speech Data may include Personal Information.

Service Quality Improvement

From time to time, we would have the right to monitor some of the voice blogs posted from the Kirusa Channels App or the website for quality of content, especially to filter out content involving a lot of noise, content that is not audible, content that is predominantly silent, voice blogs or comments that have been disliked due to adult content or breaching Terms of Use, etc.

We engage certain trusted third parties and affiliates to perform functions and provide services to us, including, without limitation, hosting and maintenance, customer relationship, database storage and management, and direct marketing campaigns. We will share your personally identifiable information with these third parties, and affiliates, but only to the extent necessary to perform these functions and provide such services, and only pursuant to binding contractual obligations requiring such third parties to maintain the privacy and security of your data.

Information Sharing and Disclosure

Sharing Information

As a matter of policy, we will not sell or rent information about You and we will not disclose information about You in a manner inconsistent with this Privacy Policy except as required by law or government regulation. We cooperate with law enforcement inquiries, as well as other third parties, to enforce laws such as those regarding intellectual property rights, fraud and other personal rights.

You may decline to submit Personally Information through the Services, in which case we may not be able to provide certain services to You. If you do not agree with our Privacy Policy or Terms of Service, please delete your account, uninstall the InstaVoice/Channels application and discontinue use of the Service; your continued usage of the Service will signify your assent to and acceptance of our Privacy Policy and Terms of Use.


Service Providers

We engage service providers to perform functions and provide services to us in the United States and abroad. We may share Your private Personal Information with such service providers subject to confidentiality obligations consistent with this Privacy Policy, and on the condition that the third parties use Your private personal data only on our behalf and pursuant to our instructions.

Business Transfers

We may sell, transfer or otherwise share some or all of its assets, including Your Personal Information and Speech Data, in connection with a merger, acquisition, reorganization or sale of assets or other change of control or in the event of bankruptcy. You will have the opportunity to opt out of any such transfer if the new entity's planned processing of Your Personal Information or Speech Data differs materially from that set forth in this Privacy Policy.

Non-Private or Non-Personal Information

We may share or disclose Your non-private, aggregated or otherwise non-personal information, such as Your public user profile information, public voice SMS or blog posts, or the number of users who clicked on a particular link (even if only one did).

Modifying/Downloading Your Personal Information

We provide You with tools and account settings to access or modify the Personal Information You provided to us and associated with Your account. Even if you have uninstalled one or all of the InstaVoice Apps (Visual Voicemail and Missed Call Alerts or Channels) from your device, you can visit here to perform one of the following actions:

1. Download and get a copy of Your personal data
2. Delete all your personal data completely. This will also deactivate your account and hence will not be visible in or In any case, we will retain the call detail records in our transactional database for a period of 90 days only, after which they will be archived.


We are very concerned about safeguarding the confidentiality of Your personally identifiable information. We employ administrative, physical and electronic measures designed to protect Your information from unauthorized access.

We will make any legally-required disclosures of any breach of the security, confidentiality, or integrity of Your unencrypted electronically stored Personal Information to You via email or conspicuous posting on this Site in the most expedient time possible and without unreasonable delay, consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

By using this Website or the Services or providing Personal Information to us, You agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of this Website or Services.

Our Site contains links to other websites. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party websites. Other sites follow different rules regarding the use or disclosure of the personally identifiable information You submit to them. Our Policy towards Children

Children under Age 13

We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for the Service or send any information about Yourself to us, including Your name, address, telephone number, or email address. No one under age 13 may provide any personal information for accessing the Service. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. Children between the Ages of 13 and 18

We recommend that minors 13 years of age or older ask their parents for permission before sending any information about themselves to anyone over the internet.

Because we operate globally, we may transfer Your Personal Information and Speech Data within our global operations to fulfill our obligations to You, but always subject to the limitations of applicable data protection law and this Privacy Policy. Kirusa entities outside the United States may have supplemental privacy policies that may apply in those countries. If You are visiting from the European Union or other regions with laws governing data collection and use that may differ from U.S. law, including those whose privacy laws may be more strict than U.S. law, please note that You are transferring Your Personal Information to the United States to us. By providing Your Personal Information you consent to that transfer and processing.

Governing Law

This Privacy Policy shall be construed and enforced according to the laws of the State of New Jersey, United States of America.

This Privacy Policy may be revised periodically, and this will be reflected by the "effective date" below. We will notify you of any changes to the policy. Your continued use of the Service constitutes your agreement to this Privacy Policy and any amendments.
